Orange Torpedo Trips Trip Cancellation Policy

Multiple Day Trips

120 + days prior to departure date all deposits are forfeited and can be reapplied 100% to any Orange Torpedo Trip adventure for 1 full season. After the following season that trip credit will be dismissed.
Less than 120 days to departure date: All deposits and trip fees will be forfeited.
Trip cancellation insurance is available on an optional basis. Insurance protects against family, medical, and in route travel emergencies.

1 and ½ Day Trips

All cancellations must be maid via email or phone 24 hours before departure date.
$50 cancellation fee per person for any cancelled trip less than 24 hours from departure date

Rentals & Shuttles

All cancellations must be maid via email or phone 24 hours before departure date.
$50 cancellation fee for any cancelled trip less than 24 hours from departure date.

Trip Cancellation Insurance

You are encouraged to purchase Trip Cancellation Protection or travel insurance if you are concerned about the possibility of canceling your trip. We offer Trip Cancellation Protection as a way for you to protect against the loss of your deposit and/or cost of your trip if you are required to cancel your trip for certain unforeseen reasons. The cost of the Trip Cancellation Protection is based on the cost of your trip as follows:

These costs are per person: for example, the cost of Trip Cancellation Protection for two $550 trips will be two payments of $24.99 NOT one payment of $34.99. The Trip Cancellation Protection must be purchased not less than 120 days prior to your scheduled departure date or at the time of your initial deposit, if later.

Terms and conditions:

We must receive in writing, at least 24 hours before the trip start date, a request for refund of any Trip Fees, together with an explanation of the reason for the cancellation. Your request must be in writing, in the form of a letter and/or email. All emails must be sent to info@orangetorpedo.com to be valid.

We have the right to deny any refund request due to insufficient information from you or for the failure to comply with these terms and conditions.

We will pay your Trip Fees if you are prevented from taking your Trip due to: Your, an Immediate Family Member's, Traveling Companion's, or Business Partner's Sickness, Injury, or Death that occurs before departure on your Trip. The Sickness or Injury must: a) commence while your Trip Cancellation Coverage is in effect under the policy; b) require the examination and treatment by a Physician at the time the Trip is canceled; and c) in the written opinion of the treating Physician, prevent you from taking your Trip.

We will also pay the Trip Fees to you if you are prevented from taking your Trip due to Other Covered Events, as defined below, that occur before departure on your Trip.

"Other Covered Events" means only the following unforeseeable events or their consequences which occur after you have purchased your Trip Cancellation Protection:

1. Air Carrier delays resulting from inclement weather, mechanical breakdown of the aircraft on which you are scheduled to travel, or organized labor strikes that affect public transportation;
2. arrangements canceled by an airline, cruise line, or tour operator, resulting from inclement weather, mechanical breakdown of the aircraft on which you are scheduled to travel, or organized labor strikes that affect public transportation.
Items #1 and #2 above, are subject to the following conditions:
a. the scheduled carrier connecting times must meet airline required minimum connect times; and
b. the scheduled time between arrival at the Scheduled Trip Departure City and the scheduled trip departure must be 1 day or longer.
3. a change in plans by you, an Immediate Family Member traveling with you, or Traveling Companion resulting from one of the following events:
a. being directly involved in a documented traffic accident while en route to departure for the trip;
b. being hijacked, quarantined, required to serve on a jury, or required by a court order to appear as a witness in a legal action, provided you, an Immediate Family Member traveling with you or a Traveling Companion is not 1) a party to the legal action, or 2) appearing as a law enforcement officer;
c. your principal residence is made uninhabitable by fire, flood, volcano, earthquake, hurricane or other natural disaster;
d. being called into active military service to provide aid or relief in the event of a natural disaster; or
e. a Terrorist Act which occurs in your departure city or in a city which is a scheduled destination for your Trip provided the Terrorist Act occurs within 30 days of the Scheduled Departure Date for your Trip.

Definitions

"Immediate Family Member" means a spouse, child or parent.
"Payments or Deposits" means the cash, check, or credit card amounts actually paid for your Trip. Payments made in the form of a certificate, voucher or discount are not Payments or Deposits as defined herein.
"Physician" means a person licensed as a medical doctor by the jurisdiction in which he/she is resident to practice the healing arts. He/she must be practicing within the scope of his/her license for the service or treatment given and may not be you, a Traveling Companion or an Immediate Family Member of yours.
"Scheduled Departure Date" means the date on which you are originally scheduled to leave on your Trip.
"Scheduled Trip Departure City" means the city where the scheduled trip on which you are to participate originates.
"Sickness" means an illness or disease of the body which: 1) requires examination and treatment by a Physician, and 2) commences while the insurance is in effect. An illness or disease of the body which first manifests itself and then worsens or becomes acute prior to the effective date of your Trip Cancellation Protection is not a Sickness as defined herein and is not covered.
"Terrorist Act" means an act of violence, other than civil disorder or riot, (that is not an act of war, declared or undeclared) that results in loss of life or major damage to property, by any person acting on behalf of or in connection with any organization which is generally recognized as having the intent to overthrow or influence the control of any government.
"Traveling Companion" means a person whose name appears with yours for reservations on the same Trip.
"Trip" means a scheduled trip for which a reservation has been made with Orange Torpedo Trips and for which Trip Cancellation Protection is purchased .
"Trip Fees" means the Payment and/or Deposits previously paid by you.
